The Competition and Markets Authority (CMA) has today, 14 August 2026, published a summary of its provisional determinations in the Energy Licence Modification Appeals 2026. The full provisional determinations will be issued to the parties involved and the intervener.
Five energy companies sought permission to appeal modifications made on 3 February 2026 to gas distribution licences. These modifications followed Ofgem's RIIO-3 price control decisions of 4 December 2025, which set out how much energy companies can charge their customers.
The CMA granted permission to appeal on all grounds raised by Cadent Gas Limited, Northern Gas Networks Limited, Southern Gas Networks plc and Scotland Gas Networks plc (joint application), and Wales & West Utilities Limited. Citizens Advice was also granted permission to intervene in relation to the grounds of appeal concerning Ongoing Efficiency.
