A heart-wrenching scene unfolded in Bristol Crown Court yesterday as Evelyn Ballentyne described discovering her four-week-old baby, Atticus Bartlett, in a lifeless state after an alleged attack by his father. The mother recounted finding Atticus 'floppy and grey', making 'gasping noises' and without any vital signs, on 16 July 2022 at their family home in Chard, Somerset.
The prosecution alleges that Tony Bartlett, 39, a postal worker, violently shook the infant, causing severe brain and spinal cord injuries, as well as several cracked ribs. It is claimed that Mr Bartlett had consumed up to nine pints of beer during a night out at a pub and comedy club before being left alone with Atticus.
Ms Ballentyne initially broke down in court while recounting the events of that fateful night, later clarifying her earlier testimony by stating she now has a 'very clear' memory. Defence counsel Nigel Power KC suggested she had sought to 'minimise' her actions, which she denied when questioned about Tony's involvement in harming Atticus.
When asked directly if his father had caused harm to the baby, Ms Ballentyne replied unequivocally: 'Yes he did.' This shocking admission comes as a devastating blow to those who have followed this tragic case. The severity of the injuries sustained by Atticus was such that despite receiving medical attention at Musgrove Park Hospital and being transferred to Bristol Royal Hospital for Children, he tragically passed away on 23 July 2022 due to irreversible brain damage.
The trial continues with further evidence expected to be presented regarding the circumstances surrounding Atticus's death and the extent of his injuries. Mr Bartlett denies both murder and manslaughter charges brought against him.
