Landlords in Reigate and Banstead could face new planning restrictions when converting family homes into small Houses in Multiple Occupation (HMOs). Reigate and Banstead Borough Council is consulting on an Article 4 direction that would remove permitted development rights for conversions housing between three and six residents.
If the direction is approved, a full planning application would be required before a home could be changed into a small HMO. Currently, HMOs for seven or more people already require planning permission.
Kate Fairhurst, the council’s executive member for place, planning and regulatory services, stated that the proposals are not intended to prevent HMOs, which can provide lower-cost housing. However, she noted an increase in HMOs and related complaints in the borough.
The council aims to implement planning checks to ensure future HMOs are in appropriate locations, are well-designed, and do not negatively impact local communities. The consultation, which opened on 30 July, will run for eight weeks, closing on 24 September 2026. Residents, landlords, and property owners are invited to comment.
After the consultation closes, the council will review feedback before deciding whether to confirm the direction. If approved, the new planning controls would come into force on 30 July 2027.
