Garvaghy Road residents lose appeal over Drumcree parade decision

The Court of Appeal has dismissed a challenge by Garvaghy Road residents against the Parades Commission's decision to permit the Drumcree parade on their road.

  • The Court of Appeal ruled against Garvaghy Road residents' challenge to the Parades Commission's decision.
  • The ruling concerned the lawfulness of the decision, not whether the march should take place.
  • The Secretary of State banned the parade on Friday, prior to the court's ruling.

Garvaghy Road residents have failed in their bid to challenge the Parades Commission's decision to allow the Drumcree parade to proceed down the predominantly nationalist road, the Court of Appeal has ruled.

Judges stated their decision was confined to the lawfulness of the commission's determination and did not decide whether the march should occur. Lady Chief Justice Dame Siobhan Keegan noted that the ruling was made before the Secretary of State banned the parade on Friday.

Residents had argued that the commission's decision was flawed in its assessment of the potential for disorder, but the court dismissed their appeal.
