British tourists experiencing issues with services or faulty items in Portugal and Spain can utilise official complaint books to assert their consumer rights. In Portugal, the 'Livro de Reclamações' (complaints book) is a legal requirement for most businesses, including restaurants, hotels, shops, and taxis, and must be readily available to customers.
If a business fails to provide the book, refuses to hand it over, or falsely claims it is only available at a company headquarters, it could face significant fines. Once a complaint form is filled out in Portugal, businesses have 15 working days to respond and must forward that response to the relevant regulator.
Spain operates a similar system with 'Hojas de Reclamaciones', which are complaint forms administered by regional authorities. While not a nationally standardised system like Portugal's, businesses are still required to provide these forms.
The act of requesting these complaint books can often encourage businesses to resolve issues, such as offering a refund or repairing a faulty item, to avoid an official complaint being escalated to a regulator.
