The government has confirmed that Right to Manage (RTM) companies are permitted to grant approval for pets in properties where leases require it. These companies may also charge fees to cover their reasonable costs associated with this process.
Baroness Taylor of Stevenage, a Labour peer, stated in a written parliamentary answer that any fees and administration charges must be reasonable and should only cover costs that have actually been incurred. She also noted that such charges should be justifiable, transparent, and clearly communicated.
Lord Truscott had asked the government about guidance for RTM companies regarding charges for approving pets. Baroness Taylor clarified that RTM companies are responsible for ensuring compliance with lease terms, including pet approvals, and are entitled to recover permission fees for reasonable costs.
Guidance for RTM companies on exercising their functions, including granting approvals, is provided by the Leasehold Advisory Service. Leaseholders have a legal right to challenge variable administration or permission charges by applying to a tribunal if they believe the charges are not fair.
