A spa manager at the renowned Carnoustie Golf Hotel & Spa, Sharon Anfield, saw her claim for constructive unfair dismissal thrown out by a Dundee Employment Tribunal. Mrs Anfield had elected to work 10 continuous days in December 2025 without informing the hotel, then resigned, citing the shift as the 'last straw'.
Mrs Anfield, who managed the spa at the hotel, was responsible for her own work rota. She alleged she was made to work 10 days in a row and had no choice but to resign from her £30,000-a-year position. However, the tribunal heard that the hotel was completely unaware she had chosen to work continuously for 10 days.
Employment Judge Michelle Sutherland dismissed Mrs Anfield's claims, stating that working 10 consecutive days was not a breach of Working Time Regulations or her contract. The judge concluded that Mrs Anfield elected to work the extended period in response to operational demands and did not resign due to a repudiatory breach of contract by the hotel.
