Luigi Mangione's guilty plea to federal stalking charges in connection with the death of UnitedHealthcare CEO Brian Thompson has raised questions regarding the separate Manhattan murder case against him. Legal experts suggest that New York's double-jeopardy law may derail the state trial.
Mangione pleaded guilty to one count of interstate stalking resulting in death and one count of cyberstalking through use of interstate facilities resulting in death. These charges are linked to a 4 December 2024 shooting outside a Midtown hotel. Both charges carry a potential maximum life sentence.
During his allocution, Mangione stated, "I shot Mr Thompson in Manhattan and he died," an admission that overlaps with the actions in his state-level murder charge. Following his plea, Mangione's legal team announced plans to seek the dismissal of the state case, arguing that its continuation would violate state double jeopardy prohibitions.
Neama Rahmani, a former federal prosecutor, explained that dual prosecutions are prohibited if they are part of the same criminal act or occurrence. Anna Cominsky, a law professor, noted that Mangione's team is arguing that a federal conviction precludes the state from prosecuting the same conduct.
Manhattan state court judge Gregory Carro is expected to issue a briefing schedule for legal arguments from both sides. This issue must be resolved before jury selection, which was slated to begin in early September. Manhattan prosecutors have stated their intention to fight efforts to dismiss the state-level case.
