A judge has refused to declare Lindsay Clancy not guilty of murder, turning down a defence motion that argued there was not enough evidence to prove she was responsible for killing her three children. Judge William Sullivan stated that prosecutors had provided adequate evidence for a jury to decide the matter.
Clancy's attorney, Kevin Reddington, had attempted to persuade Judge Sullivan that prosecutors had not offered proof of Clancy killing her children. Prosecutors, however, argued there was ample evidence.
During Clancy's initial trial, which ended in a mistrial with a deadlocked jury, the defence did not dispute that Clancy killed the children in 2023. Instead, the defence sought to argue that Clancy, 36, was not criminally responsible due to postpartum psychosis. Prosecutors acknowledged Clancy's mental health issues but contended she knew her actions when she allegedly strangled the children and then attempted to take her own life.
